Yes!! I have tried. I contacted 5 or 6 high-profile law firms, and every one had the same answer: that in Wisconsin, jurys will side with doctors in this type of case. They have told me that, since I am not permanently disabled, and can still work my job, etc, that I would not win. In my case, I was told that I had a lung rumor that needed to come out immediately. I even ASKED about a biopsy but the surgeon said I didn't need one...and that he would test the tumor for malignancy when he got in there. If malignant, he would take out the whole lobe. If not, he would just cut out the tumor. Well, when he got in there he did not test, he just cut out the whole lower lobe of my left lung. Found out a few days later it was Blasto, and that the surgery never should have happened. Also gound out (after the fact) that the radiologist had recommended biopsy and other further testing, and the surgeon ignored it and did not give me any other options.
